A federal appeals court dismissed a class-action lawsuit filed by a patron of a fast-casual restaurant chain, whose information was stolen in a data breach.

And Marie A. Borland, a partner at Hill Ward Henderson in Tampa, who represented defendant Captiva MVP Restaurant Partners LLC, doing business as PDQ, said the U.S. Court of Appeals for the Eleventh Circuit was one of the few federal circuits that had not yet weighed in on this increasingly pressing issue.
